TERMS AND CONDITIONS OF USE

1. GENERAL INFORMATION

This document sets forth the terms and conditions governing the use of this website (hereinafter referred to as the "Website") and the conditions applicable to the purchase of products offered through it.

The owner of the Website and the seller of the products is OVERSKIN ENTERTAINMENT SRL, headquartered in Cluj-Napoca, Romania, registered with the Romanian Trade Register under no. J12/382/2020, VAT Registration No. RO42205974.

2. DEFINITIONS

Seller: OVERSKIN ENTERTAINMENT SRL

Buyer: Any natural person (at least 18 years of age) or legal entity placing an order through the Website.

Promotional Campaign: A commercial sales campaign during which selected products are offered at reduced prices, subject to available stock, for a limited period of time.

3. DISCOUNT AND CLEARANCE CAMPAIGNS (SUMMER SEASON 2026)

During the period 09 July 2026 – 01 September 2026, two distinct types of price reduction campaigns will be conducted on our Website, in accordance with the applicable Romanian legislation (Government Ordinance No. 99/2000).

A. "Summer Sale" Campaign (Commercial Promotion)

Campaign Period: 09 July 2026 – 01 September 2026

Details:

This is a standard promotional campaign applicable to selected clothing products.
The discounted prices offered during this campaign continue to include the Seller's commercial profit margin.
Discounts apply only to products included in the campaign.
All discounts are valid while the allocated promotional stock lasts.

B. "Clearance Sale" Campaign (Stock Clearance)

Campaign Period: 01 August 2026 – 01 September 2026 (maximum 32 days)

Details:

This campaign is organized exclusively for inventory clearance purposes.
It involves the accelerated sale of the remaining items from the Spring/Summer collection, including sales below their purchase or production cost, in accordance with Article 27 of the Romanian Government Ordinance No. 99/2000.
Clearance prices apply only while the allocated clearance stock lasts.

Strictly Limited Stock:

Shirts: Initial clearance stock – 13 units
Vintage Elephant Patch Caps: Initial clearance stock – 10 units

4. PRICE DISPLAY AND PURCHASE POLICY

Reference Price

For all discounted products (both Summer Sale and Clearance Sale items), the Website will display the new sale price alongside the crossed-out reference price.

The crossed-out reference price represents the lowest price applied by our store during the 30 days preceding the price reduction, in accordance with applicable legislation.

Product Availability

Adding a product to the shopping cart does not reserve inventory.

Stock is allocated automatically in the order in which purchases are successfully completed (payment confirmation).

Due to the extremely limited clearance stock (13 and 10 units respectively), if the available stock is exhausted while you are completing your purchase, you will be notified immediately, and the transaction for the unavailable product(s) will not be processed.

5. SHIPPING AND RETURN POLICY

Shipping

Products will be delivered by express courier within 10 business days from the confirmation of the order.

During peak campaign periods (10–15 July and 1–5 August), delivery times may be extended to up to 15 business days.

Right of Withdrawal (Returns)

In accordance with the applicable consumer protection legislation, the Buyer has the right to withdraw from the purchase contract (return the products) within 14 calendar days from receiving the order, without providing any reason.

Return Conditions

The right of return applies equally to products purchased during both the Summer Sale and the Clearance Sale campaigns.

To be eligible for a return, products must be returned in the same condition in which they were received:

Unworn
Unwashed
Free of stains, damage, or signs of use
With all original tags and labels attached

The cost of return shipping shall be borne by the Buyer.

6. INTELLECTUAL PROPERTY

All content available on the Website, including but not limited to text, images, graphics, logos, and other materials, is the exclusive property of the Seller and is protected by applicable copyright and intellectual property laws.

Any reproduction, distribution, modification, or use of such content without the Seller's prior written consent is strictly prohibited.

7. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and Conditions shall be governed by and construed in accordance with the laws of Romania.

Any dispute arising between the Seller and the Buyer shall first be resolved amicably through mutual agreement.

If an amicable resolution cannot be reached, the dispute shall be submitted to the competent courts having jurisdiction over the Seller's registered office or may be resolved through the European Online Dispute Resolution (ODR) Platform, where applicable.

These terms apply to all users of the domains naluunderwear.com and their sub-domains (henceforth: the site). The terms and conditions will be valid for all your future transactions with OVERSKIN ENTERTAINMENT SRL and visits to the site. OVERSKIN ENTERTAINMENT SRL reserves the right to revise these terms and conditions and users are responsible for keeping themselves updated with such changes.

Disclaimer

OVERSKIN ENTERTAINMENT SRL does not guarantee that all items included in the QUITE LUCKY web shop are in stock at the time of your order. In the event that an item is unavailable, OVERSKIN ENTERTAINMENT SRL will contact you shortly by phone or by e-mail. OVERSKIN ENTERTAINMENT SRL cannot promise that the content of the site is free of inaccuracies or typographical errors at all times. Neither can we guarantee that all information is up-to-date. OVERSKIN ENTERTAINMENT SRL may, at any time, amend the content of the site. Although OVERSKIN ENTERTAINMENT SRL strives to display the correct texts, images and pricing on the site and web shop, errors may occur. If you have been charged the wrong amount in the web shop, OVERSKIN ENTERTAINMENT SRL will give you the option of placing a new order with the correct price or cancelling your order. OVERSKIN ENTERTAINMENT SRL, however, reserves the right to cancel any order prior to dispatch should we find that the price is incorrect. In such case we will notify you by email. If we are unable to contact you, your order will be automatically cancelled. Part of the services mediated through the site are maintained by outside organisations. In situations where OVERSKIN ENTERTAINMENT SRL acts as agent for such services, we cannot be held responsible for any errors resulting from their activities. OVERSKIN ENTERTAINMENT SRL cannot be held responsible for any damage caused from using the site or, for that matter, not being able to use the site. OVERSKIN ENTERTAINMENT SRL reserves the right to seek all solutions available at law and in equity for violations of these Terms and Conditions, including the right to block access to the site. Individuals violating the restriction of password-protected areas of the site may be subject to prosecution.

Force majeure

In case of Force Majeure, OVERSKIN ENTERTAINMENT SRL’s obligations will be suspended. The contract between you and OVERSKIN ENTERTAINMENT SRL can, in such cases, be partially or fully terminated by yourself or by OVERSKIN ENTERTAINMENT SRL. A Force Majeure is in the event of war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters or similar events. Under such circumstances, OVERSKIN ENTERTAINMENT SRL will attempt to resolve all issues in a timely manner.

Governing law

These terms of use are compiled in accordance with Romanian law and the Romanian courts will have exclusive jurisdiction for any dispute under this agreement. The laws of your country may differ from Romania and there may be additional legal requirements to use this website. You must comply with all applicable local and international laws and regulations regarding your use of our website.
